Fly tipper fined for dumping waste on Forrest Way

The fly tipper pleaded guilty to dumping waste on behalf of a third party in Bewsey and Whitecross.

James Donoghue, 26, of Siddeley Drive, Newton-le-Willows, agreed to dispose of waste on behalf of a third party and fly tipped it at the roadside along Forrest Way in Bewsey and Whitecross.

The waste, consisting of bags of general household waste along with cardboard boxes, originated from a house in Grasmere Avenue, Orford.

The occupier put out a request on Facebook for someone to remove the waste from their garden. The person who accepted the job subsequently passed the waste onto Mr Donoghue.

The incident was reported to the council who, during the investigation, identified James Donoghue as the offender.

Mr Donoghue pleaded guilty to the offence at Warrington Magistrates Court on the 29 September. He was given a fine of £480, as well as a charge of £121 for the removal costs of the waste and a £48 victim surcharge.

Cllr Hitesh Patel, cabinet member for environment, housing and public protection, said: “If you need to dispose of waste, it is vital that you check that anyone who offers to take your waste away is authorised and certified to do so.

“Anyone who advertises or responds to waste collection and disposal requests on social media should always be able to provide proof that they are licensed to carry and dispose of waste in Warrington.

“Residents are legally responsible for the disposal of their own waste and can fall victim to unlicensed operators and potentially face a fine themselves if their waste is not disposed of correctly.”
